hese Terms of Use (the “Terms”) are a legal agreement between you (“you” or “User”) and Run With Zeal LLC (“Zeal,” “we,” “us,” or “our”) governing your access to and use of the Run With Zeal mobile applications (the “App”), the website (https://www.runwithzeal.com) (the “Website”), and related products and services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. The Services

Zeal provides live and on-demand group coaching and running experiences through the App, including schedules, coaching audio, community features, session tracking, and related content. We may also operate the Website for information, support, and merchandise.

Zeal may modify, suspend, or discontinue any part of the Services at any time.

2. Eligibility

You must be at least eighteen (18) years old to use the Services. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account registration

You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@runwithzeal.com if you suspect unauthorized access.

We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe create risk for Zeal, other users, or the public.

4. Health and safety disclaimer

THE SERVICES PROVIDE FITNESS AND INFORMATIONAL CONTENT ONLY AND ARE NOT MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Always consult a physician before beginning any exercise program, especially if you have any medical condition, injury, or other health concern. Physical exercise involves inherent risk of injury or death. You assume all risk arising from your participation in any activity related to the Services.

You are solely responsible for:

- Your physical condition and readiness to exercise

- Choosing a safe environment (including awareness of traffic, terrain, weather, treadmill or equipment settings, and surroundings)

- Using headphones and devices safely

- Stopping immediately if you feel pain, dizziness, shortness of breath, or other warning signs

Zeal coaches and content providers are not your personal physicians or healthcare providers. Zeal does not have the ability to contact or call upon emergency services.

5. License to use the Services

Subject to these Terms, Zeal grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own personal, non-commercial use.

You may not:

- Copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the App or Services

- Circumvent security or access controls

- Scrape, harvest, or collect data or user information through automated means

- Interfere with or disrupt the Services

- Use the Services for any unlawful purpose

All rights not expressly granted are reserved by Zeal and its licensors.

6. Subscriptions, trials, and payments

Certain features require a paid auto-renewable subscription (for example, Zeal Premium). We may also offer a free trial.

On iOS devices. If you purchase a subscription through the Apple App Store on an iOS device, payment is charged to your Apple ID account and processed by Apple. The subscription title, length, price, and included services are presented in the App and/or App Store product information at the time of purchase.

Auto-renewal (iOS). Subscriptions purchased on iOS renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current rate.

Trial (iOS). If a free trial is offered, the length of the trial will be disclosed in the App or App Store listing. Unless you cancel before the trial ends according to Apple’s rules, the subscription may convert to a paid auto-renewing subscription and your Apple ID will be charged.

Manage and cancel (iOS). On iOS devices, manage or cancel subscriptions in your Apple ID account settings (Settings → [your name] → Subscriptions, or via Apple’s subscription management website). Deleting your Zeal account does not by itself cancel an Apple subscription purchased on iOS.

Refunds (iOS). Refund requests for Apple App Store purchases on iOS are handled by Apple under Apple’s terms and policies.

Price changes. We or the applicable app store may change subscription pricing prospectively as permitted by applicable rules; changes will be communicated as required.

Android. Paid subscriptions on Android (for example via Google Play) may be offered in a later release. When available, billing, renewal, cancellation, and refunds for Android purchases will be handled through Google Play (or the then-current Android store) under that store’s terms, and will be described in the App at the time of purchase.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy at (https://www.runwithzeal.com/privacy). By using the Services, you consent to that collection and use.

8. Location and microphone

Certain features require device permissions:

- Location during active runs to calculate distance and pace (including background location while a session is active, if you allow it)

- Microphone for live coaching audio and guest speakers

- Camera / photos if you upload images

- Notifications if you enable reminders

You can revoke permissions in device settings; some features may stop working.

9. Live audio and recordings

By joining a live session, you understand that your microphone audio may be transmitted to coaches, if a guest speaker, and other participants and that sessions may be recorded for on-demand playback by members. Do not share sensitive information you do not want other participants or recordings to include.

10. User content

You may submit content to the Services (“User Content”), including chat messages, photos, profile information, and feedback.

You retain ownership of your User Content. By submitting User Content, you grant Zeal a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in connection with operating, improving, promoting, and providing the Services. This license survives termination of these Terms to the extent needed for recordings, backups, or content already distributed.

You represent that you have all rights needed to submit User Content and that it does not violate law or third-party rights.

We may remove User Content at our discretion. Requests to remove content that depicts your physical appearance may be submitted to support@runwithzeal.com and will be considered in good faith.

You are solely responsible for your conduct on the Services, including communications during live sessions.

11. Acceptable use

You agree not to:

- Harass, abuse, threaten, or harm others

- Post illegal, defamatory, obscene, or infringing content

- Impersonate others or misrepresent your affiliation

- Attempt to gain unauthorized access to accounts, systems, or data

- Use the Services to spam or solicit users without permission

- Interfere with live sessions or other users’ enjoyment of the Services

We may suspend or terminate access for violations.

12. Intellectual property

The Services—including software, design, text, graphics, logos, audio, video, and other content provided by Zeal—are owned by Zeal or its licensors and protected by intellectual property laws. These Terms do not transfer ownership to you.

13. Third-party services and links

The Services may integrate with or link to third parties (for example, on iOS: Apple; Firebase/Google Cloud; LiveKit). Their terms and privacy policies apply to their services. Zeal is not responsible for third-party services.

14. Account deletion

You may delete your account from within the App (account/profile settings → Delete Account). Deletion is permanent and will remove your access to the Services. See our Privacy Policy for details on what personal data is deleted and what limited records may be retained.

Important: Deleting your Zeal account does not cancel subscriptions billed by Apple on iOS devices. On iOS, cancel through Apple to stop recurring charges. When Android paid billing is offered, cancel through that store as described in the App.

If you cannot access the App, contact support@runwithzeal.com for assistance with account deletion.

15. Termination

You may stop using the Services at any time and may delete your account as described above.

We may suspend or terminate your access immediately, without prior notice, if you violate these Terms, if required by law, or if we discontinue the Services. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; OR THAT DEFECTS WILL BE CORRECTED. WE RELY ON THIRD PARTY PROVIDERS FOR DATA MANAGEMENT, VOICE COMMUNICATIONS, AND GENERAL CONNECTIVITY. THESE SERVICES MAY EXPERIENCE SUBOPTIMAL PERFORMANCE OUTSIDE OF OUR CONTROL. USE OF THE SERVICES IS AT YOUR SOLE RISK.

WE DO NOT WARRANT THE ACCURACY OF DISTANCE, PACE, OR OTHER METRICS, WHICH DEPEND ON DEVICE SENSORS, GPS CONDITIONS, AND OTHER FACTORS OUTSIDE OUR CONTROL.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEAL AND ITS AFFILIATES, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEAL’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ZEAL FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

18. Indemnification

You agree to defend, indemnify, and hold harmless Zeal and its officers, directors, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right.

19. Merchandise (Website shop)

If we offer physical goods for sale on the Website, separate checkout terms (including pricing, shipping, taxes, and returns) may apply at purchase. Unless expressly stated otherwise, App subscriptions are digital services and are not shipped goods. For merchandise issues, contact support@runwithzeal.com.

20. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. You agree that exclusive venue for disputes arising out of or relating to the Services or these Terms shall be state or federal courts located in Atlanta, Georgia, and you consent to personal jurisdiction there, except where prohibited by law.

To the extent permitted by law, any claim must be filed within one (1) year after it arises, or be permanently barred.

21. Changes to these Terms

We may update these Terms from time to time by posting a revised version on this page and updating the “Last Updated” date. Material changes may also be communicated in the App or by email. Continued use after changes become effective constitutes acceptance, except where applicable law requires otherwise. If you do not agree, stop using the Services and delete your account.

22. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms presented for specific features, are the entire agreement between you and Zeal regarding the Services and supersede prior agreements on that subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them without restriction. Headings are for convenience only.
